Концептуальні напрями подальшого розвитку експертної роботи в митній справі у контексті забезпечення митної безпеки держави

Abstract

UK: З набуттям чинності Угодою про спрощення процедур торгівлі перед нашою державою постала низка завдань щодо спрощення та уніфікації процедур митного та інших видів державного контролю за товарами, які переміщуються через кордон України. У статті розглянуті положення чинної редакції Митного кодексу України стосовно експертної діяльності у митній справі. Проаналізований розміщений на офіційному сайті відомства звіт про роботу експертного підрозділу ДФС України за 2017 рік. Виділені положення УСПТ, під час реалізації яких необхідна участь експертних підрозділів ДФС України. Запропоновані концептуальні шляхи подальшого розвитку цієї діяльності на основі документів ВМО та досвіду роботи митниці США (CBP USA).

RU: С вступлением в силу Соглашения об упрощении процедур торговли перед нашим государством встал ряд задач по упрощению и унификации процедур таможенного и других видов государственного контроля за товарами, которые перемещаются через границу Украины. В статье рассмотрены положения действующей редакции Таможенного кодекса Украины относительно экспертной деятельности в таможенном деле. Проанализирован размещенный на официальном сайте ведомства отчет о работе экспертного подразделения ДФС Украины по 2017 год. Выделены положения УСПТ, при реализации которых необходимо участие экспертных подразделений ДФС Украины. Предложены концептуальные направле- ния дальнейшего развития этой деятельности на основе документов ВТО и опыта работы таможни США (CBP USA).

EN: Now before our state a number of tasks arose regarding simplification and unification of customs and other types of state control over goods transported across the border of Ukraine in connection with the entry into force of the Agreement on Facilitation of Trade Procedures. The article deals with the provisions of the current version of the Customs Code of Ukraine with regard to expert activity in the customs field. Analyzed, posted on the official website of the department report on the work of the expert division of the SFS of Ukraine for 2017. The modern concept of expert activity in the SFS of Ukraine is to carry out the largest possible number of laboratory investigations. The expert work productivity measures tin the number of conducted analyzes. Allocation of the TFA, which requires the participation of expert divisions of SFS of Ukraine. The conceptual ways of further development of this activity are proposed based on the WCO documents and the work experience of the US Customs (CBP USA). Some conclusions were made on the basis of these materials: 1. In the opinion of the author, conceptual directions of development of expert activity in customs should be the implementation of the concept of economic efficiency and project performance of customs laboratories in the practice of the work of the customs authorities of Ukraine. 2. Derivation on the need to start work on making appropriate changes to the Ukrainian legislation on customs and expert work on the implementation of the concepts of customs laboratories allocation by type and accreditation of commercial laboratories and scientific institutions in the customs authorities of Ukraine for conducting commodity research during their customs control and clearance. The further development of expert work in the customs authorities in Ukraine, described in this paper, will allow to reduce the costs of customs control procedures and simplify the mechanisms of international trade.
