Аспекти рентоорієнтованої поведінки в гірничозбагачувальній галузі в контексті перерозподілу прав власності: міжнародний досвід та перспективи

Abstract

UK: Розглядаються концептуальні аспекти рентоорієнтованої поведінки суб'єктів рентних відносин на прикладі гірничозбагачувальної галузі в межах інституційного підходу. Розглянуто та обґрунтовано градацію прав власності на надра між державою та підприємцем-орендарем надр, зроблені спроби її адаптації до сучасного законодавства України у сфері надрокористування, яка дає змогу вирішити проблему отримання ренти в гірничозбагачувальній галузі. Взаємодія суб'єктів рентних відносин розглянута з позиції вирішення принципових питань: рентогенерації та рентоотримання на підставі узгодження економічних інтересів щодо рентоотримання.

RU: Рассматриваются концептуальные аспекты рентоориентированного поведения субъектов рентных отношений на примере горнообогатительной отрасли в рамках институционального подхода. Рассмотрена и обоснована градация прав собственности на недра между государством и предпринимателем- аредатором недр, сделаны попытки ее адаптации к современному законодательству Украины в сфере недропользования, которая позволяет решить проблему получения ренты в горнообогатительной от- расли. Взаимодействие субъектов рентных отношений рассмотрено с позиции решения принципиальных вопросов: рентогенерации и рентополучения на основе согласования экономических интересов относительно рентополучения.

EN: The conceptual aspects of rent-seeking (or rent-oriented) behavior of subjects of rent relations on the example of the ore mining industry within the framework of the institutional approach are considered. The decision of the problem of realization of ownership rights to mineral resources in Ukraine is becoming increasingly relevant in connection with the need to replenish the revenue part of the State Budget at the macro level and obtaining additional cash receipts at the micro level, which, simultaneously, would fulfill several economic functions at different levels of the economic environment: pricing; intermediary; informing; regulating; wellness. Based on the detailed classification of property rights A. Onoré, the analysis and consideration of existing provisions regarding the current situation in the Ukrainian mining and processing sector, taking into account the specifics of the transformational economy and the current legislation, was conducted. Based on the overall assessment of the level of protection of property rights in Ukraine in 2017, international experts found that it remains extremely low. That is why it is expedient to consider and substantiate the gradation of ownership rights to the subsoil between the state and the entrepreneur. The article attempts to adapt it to modern Ukrainian legislation in the field of subsoil use, which allows solving the problem of obtaining and redistribution of rent in the mining and extraction industry. The interaction of the subjects of rent relations is considered from the point of view of solving the principal issues: renting and renting on the basis of harmonization of economic interests in terms of rent. The redistribution of ownership rights can not fully disclose the complexity, diversity and diversity of property relations in rent-oriented behavior, but allows us to reconcile needs and economic interests not only at the theoretical level, but also to resolve specific practical problems regarding the distribution of rental income received on shares of the state and the entrepreneur, the tenant of the subsoil.
