Саморегулівні організації, як елемент інфраструктури ринку цінних паперів України

Abstract

UK: У статті досліджені важливість процесу саморегуляції, як одного з напрямків регулювання інфраструктури ринку цінних паперів, і наведена міжнародна практика саморегулівних процесів. Піднімається питання неоднозначного трактування та множинного підходу навіть у чинному законодавстві України до поняття «саморегулівна організація». Вивчений та описаний сучасний стан саморегулювання в Україні та інституції-учасники саморегулівних процесів, їх можливості та повноваження. Виявлено мінімальне делегування повноважень саморегулівним організаціям зі сторони державних інституцій з регулювання ринку цінних паперів. Для можливості делегування повноважень СРО запропонований ряд питань, які слід вирішити. В Україні в напрямку саморегулювання сформувались єдині СРО за основними видами професійної діяльності. Розглянуто ставлення вчених до такого стану, яке умовно розподілилось на прибічників та противників такої «єдності» серед саморегулівних організацій. В статті запропоновані рекомендації щодо переходу ринку цінних паперів та його інфраструктури до моделі саморегуляції.

EN: There has been explored the importance of self-regulating process as one of the ways of regulation infrastructure of securities market and provided the international practice of self-regulating processes in this article. It has been emphasised the question of ambiguous interpretations and multiple approach to the concept of «self-regulatory organization» in the legislation of Ukraine. Therefore, has been described present situation of self-regulation in Ukraine and the institutions participating in self-regulating processes, their capabilities and powers in the article. The minimum delegation of powers has been revealed to self-regulatory organizations from state institutions for regulation of the securities market. A number of issues have been proposed, which should be solved for the possibility of delegating authority to the self-regulatory organizations. The SRO core of the main types of professional activities has been formed in Ukraine. The attitude of scientists has been considered and divided their into supporters and opponents of this "unity" among the SROs. Helpful recommendations have been proposed for the transition of the securities market and its infrastructure to the model of self-regulation.
